Azooca™ Terms AND Conditions
This policy is effective August 1st, 2008 and subject to periodic changes.

Purchase Shipping Policy

Thank you for purchasing Azooca™ products and/or services! This set of terms and conditions defines our corporate policies regarding electronic commerce. Although these policies appear rigid, they provide a framework for decisions and expectations between our company and our valued customers.

Delivery Time

Typically, physical items will be shipped the next business day (Monday – Friday, excluding US holidays). Electronic goods are processed and distributed almost immediately.
When you place an order with Azooca.com for a physically shipped product, we will provide an estimated shipping date. With this date and your chosen shipping method you can estimate a delivery date to your home or office. These estimates will accompany your email order confirmation.

Calculating Cost

Shipping and handling costs for physically shipped orders from Azooca.com depend upon the method and option you choose and are calculated during the order process. These costs are based upon distance, method of deliver, and size and weight of the packages.

Return Policy

Contacting Azooca™ Customer Service

If you need to return an physical item, our customer service staff will guide you through the returns process and provide you with a printable return shipping label. Contact Azooca™ Customer Service by email at service@golive2.com. Please include the following information:
  1. Your name and contact information (email and telephone)
  2. Your order number.
  3. The UPC product/item number
  4. Where you purchased the product
  5. When you purchased the product
  6. The problem you are experiencing with the product
  7. And, let us know if you want to exchange, return the unit, or just need technical assistance

Customer service will send you a Return Material Authorization (RMA) with shipping instructions should a return be necessary.

Refunds

Azooca.com will accept returns for Azooca™ physical products within 30 days of delivery. No refunds will be issued after this time. Azooca™ will not accept products without an RMA.

Items that are Not Returnable or Exchangeable

Azooca.com does not accept returns of the following items:

• G-Coin (Azooca™ Online Currency) Purchases
• Gift cards/certificates; or, VIP Subscriptions
• Orders that were delivered more than 30 days ago.
• Orders beyond the prescribed warranty period.
• Any product missing the UPC product code.
• Any downloadable software products.

Restocking Fees & Partial Refunds for Physical Products
  1. All products returned to Azooca.com will be subject to 20% restocking fee unless the product was defective or shipped by our error.
  2. An additional restocking fee may be assessed if the product is missing components or has been damaged during shipment. The restocking fee will be based upon the cost necessary to restore the product to a sellable condition.
  3. Customer will pay shipping costs to return products unless the product was defective or shipped by our error. Be sure to contact Azooca™ Customer Service for a Return Merchandise Authorization and shipping label.
  4. Shipping and Handling will be refunded only if the product was shipped through our error or the product was defective.


Exchanges

If you received a faulty item and need to exchange it for the same item, contact Azooca™ Customer Service to request a replacement. If you would like to exchange an item for a different one, please contact us (you will be refunded your original purchase price once we receive the item) and place another order for the item you wish to purchase. You do not have to wait for us to receive the original item before placing the new order.

Using our Return Mailing Label

The return mailing labels obtained from Azooca™ Customer Service are valid only for returns shipped within the U.S. These mailing labels will expire if not shipped within 7 calendar days. Each return mailing label is coded for a specific shipment. Please do not include items from other orders, or other shipments from the same order, in the same box, or you will not receive the correct refund. Each shipment must be returned using a separate mailing label. Ensure that the mailing label is placed on the outer-most box and is clearly visible to shipping personnel.
If you use this mailing label and the return is a result of our error (you received an incorrect or defective item, etc.), we'll pay the return shipping costs.
If you use this mailing label and your return is not the result of our error, the shipping cost of that returned item will be deducted from your refund. The amount deducted will be equivalent to our standard shipping cost for that item.

How long does it take to receive my refund?

Refunds are authorized after we receive and process your return. You should expect to receive your refund within four weeks of giving your package to the return shipper. We'll notify you via e-mail of your refund once we've received and processed the returned item.
If the return or refund does not appear within four weeks from the day you sent us your return, please e-mail us for further assistance.

How will my refund be issued?

Orders placed by credit card will be refunded on the same credit card within 3 to 5 business days after we have received and processed the return item.

Gift Cards

Redemption

Gift Cards must be redeemed through the Azooca™ Web site, http://www.Azooca.com, toward the purchase of eligible products. Purchases are deducted from the Gift Card balance. Any unused balance will be placed in the recipient's Gift Card account when redeemed. If an order exceeds the amount of the Gift Card, the balance must be paid with a credit card or other available payment method. To redeem or view Gift Card balances, visit "My Account" on Azooca.com.

Limitations

  1. Gift Cards cannot be redeemed for purchases from some third party sellers.
  2. Gift Cards cannot be used to purchase other Gift Cards.
  3. Gift Cards cannot be reloaded, resold, transferred for value, redeemed for cash or applied to any other account, except to the extent required by law. Unused Gift Card balances in a Azooca™ account may not be transferred.
Risk of Loss

The risk of loss and title for Gift Cards pass to the purchaser upon our electronic transmission to the recipient. We are not responsible for lost or stolen Gift Cards.

Fraud

Azooca.com will have the right to close customer accounts and request alternative forms of payment if a fraudulently obtained Gift Card is either redeemed through the Azooca.com Web site or is redeemed and used to make purchases on the Azooca.com Web site.

Previously Expired Gift Cards

The expiration date for Gift Cards issued after October 1, 2005 are waived and may be redeemed for eligible purchases notwithstanding any stated expiration date. Any Gift Cards issued prior to that date expire in accordance with their terms. Expiration dates also do not apply for Gift Cards issued in CA, CT, LA, ME, MD, MA, MT, NH, ND, OK, RI, VT, WA. Expiration dates do not apply in any other state solely to the extent as prohibited or limited by law.

VIP Subscriptions

Terminating a Subscription

VIP Subscriptions are purchased in monthly increments and paid for in advance for a specified term (one month, three month, 6 month, etc.). Incentives are offered (lower monthly fees, G-Coins, etc) to promote longer subscription term purchases. Purchaser understands that he/she will forfeit the unused portion of the subscription if the subscription is terminated before the end of the term.

Automatic Renewals

Monthly subscriptions will automatically renew without notice, confirmation, or receipt. Terminating service will also terminate the automated renewal process.

Limitation of Liability

PLAYHUT, INC., DBA “GOLIVE2” AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

Disputes

Any dispute relating in any way to Azooca.com eCommerce in which the aggregate total claim for relief sought on behalf of one or more parties exceeds $7,500 shall be adjudicated in any state or federal court in Los Angeles County, California, and you consent to exclusive jurisdiction and venue in such courts.

General Terms

By visiting Azooca.com, you agree that the laws of the State of California, without regard to principles of conflict of laws, will govern these Purchase Terms and Conditions. Azooca™ reserves the right to change these terms and conditions from time to time in its discretion. All terms and conditions are applicable to the extent permitted by law.
